Terms and Conditions for Booking and Cancellation

The Australian Women in Security Network (AWSN) provides training programs and events for members and non-members of the AWSN, across Australia.

 

Definitions

ACL - The Australian Consumer Law (as embodied in Schedule 2 to the Competition and Consumer Act 2010 (Cth))

Agreement – we mean these terms and conditions

Service – we mean a training program or other event that is arranged and/or provided by AWSN

We, us or our – we mean AWSN

You or your – we mean the person who is seeking to make a booking to attend a training program or event

 

Application of these Terms and Conditions

These terms and conditions for bookings and cancellations apply to all Services and constitute a legal agreement between you and us.

By making a booking for a Service, you agree to these terms and conditions.

If you make a booking on behalf of someone else, you undertake to notify them of these terms and conditions and any other terms and conditions notified to you at the time of making a booking.

We may impose other terms and conditions in relation to specific Services, in which case you will be notified of these at the time of making a booking and ahead of making a decision to proceed, including in the information provided on our website relating to the specific Service.

 

Your obligation in making a booking

You warrant that all information provided by you to AWSN in your booking registration is complete, up to date, and accurate.

Payments are to be made upon registration by you for the relevant Service, via the Booking Registration form on our website. Full payment is required at the time of booking. All amounts quoted are in Australian Dollars (AUD) and exclude GST.

 

Confirmation of booking

When we receive your completed registration and confirmation of payment, we will contact you with further details about the chosen Service.

 

Cancellation of service by AWSN

We may cancel a Service in the following circumstances:

  • an external provider engaged to provide the Service is no longer able to provide the Service and we are unable to engage an alternative provider;
  • the venue at which the Service is to be provided is no longer available because it has been damaged, is inaccessible, is otherwise unsuitable or for any reason;
  • the number of attendees registered for the Service is insufficient to support the Service being offered; and
  • for any other reason at the entire discretion of AWSN.

If we cancel a Service for which you are registered, we will refund the payment made by you to book the Service.

 

Variation of service by AWSN

There may also be circumstances in which we need to materially vary a Service.

The following may amount to a material variation of a Service by AWSN:

  • the content of the Service is substantially altered such that it covers different material to what was originally offered, including because an external provider is no longer available to provide the Service as planned;
  • the timing of the Service is changed other than in a minor way, including due to the availability of external providers and venue;
  • the location of the Service is changed in such a way that it may no longer be accessible for some Participants, including due to availability of venue; and
  • any other material change at the entire discretion of AWSN.

A minor change to program content (for example, a small change to a component of the content), timing (for example, starting the Service a short time later than originally planned) or location (for example, relocation to a nearby and similar venue) is not a material variation for the purposes of this Agreement.

If we materially vary a Service, we will seek to accommodate you by offering to register you for another Service. If no suitable alternative is available, or if you decline to accept the alternative offering, we will refund the payment made by you to book the Service, as if the Service had been cancelled.

 

Cancellation by you

You may cancel for any reason. If you wish to cancel your booking, you must notify us immediately in writing (this includes by email, but not by text message). The cancellation will take effect when we acknowledge receipt of your cancellation notification. We will acknowledge receipt of a cancellation notification as soon as is reasonably practicable.

Refunds will be made on the following basis:

  • If you cancel more than 15 (fifteen) days before the Service commences, we will refund 100% of the amount paid by you to book the Service.
  • If you cancel between 7 (seven) and 15 (fifteen) days before the Service commences, we will refund 50% of the amount paid by you to book the Service.
  • If you cancel fewer than 7 (seven) days before the Service commences, no refund will be provided.

If you fail to attend the Service, or withdraw for any reason after commencement of the Service, no refund will be provided.

In the case of cancellation by you, AWSN will charge a small administration fee of no more than $5 in processing any refund, comprising of merchant and administration fees. This includes third party fees imposed on AWSN. That administration fee will be deducted from the refund otherwise available to you and will not exceed the amount of the refund. Where the value of the refund does not exceed the value of the administration fee, no refund will be provided, which AWSN will confirm to you in writing.

 

Cancellation of participant's registration

We may cancel your booking for a Service, or exclude you from participating in a Service, because you have breached the terms and conditions of participation in our Services in one of the following ways:

  1. We have not received payment for your booking;
  2. You behave in a threatening, disruptive or offensive manner while attending a Service;
  3. You interfere unreasonably with another participant's enjoyment of a Service; or
  4. You interfere with our staff in carrying out their functions in relation to the Service.

If we cancel your booking for a Service, or exclude you from participating in a Service, because you have breached the terms and conditions of participation in our Services, we will retain 100% of the full amount paid by you to book the Service.

 

Refunds at AWSN's discretion

At our entire discretion, we may provide a refund in part or in full if you cancel your registration for reasons outside of your control or there are compassionate reasons for providing a refund or for any other reason.

 

Payment of refunds

AWSN aims to process your refund crediting your account within 20 days after registration is cancelled in accordance with this Agreement. If there is a delay in processing your refund, AWSN will contact you to explain the reasons for this delay and provide an update on timing.

 

Changes to Terms and Conditions

We may, at our entire discretion, amend these terms and conditions from time to time. If we do so, we will update our website, and the amended terms and conditions will be provided with any future booking. You should review these terms and conditions before you book a Service.

 

Liability

The Australian Consumer Law includes certain guarantees in relation to the supply by us of services to you. We will comply with our obligations under the Australian Consumer Law. We do not provide any warranties or guarantees over and above that set out in the Australian Consumer Law.

 

Entire agreement

Subject to the paragraph below, this Agreement contains the entire agreement between the parties about its subject matter. Any previous understanding, agreement, representation or warranty relating to that subject matter is replaced by this Agreement and has no further effect. For the avoidance of doubt, nothing in this clause is intended to exclude liability for fraudulent misrepresentation, or any other representations which cannot be excluded by law.
